1. Parties
These terms apply between No Ack Infrastruktur AB, org. no. 559513-5794 (hereinafter “we” or “the Provider”), and the customer who orders services (hereinafter “the Customer”).
2. Services
We provide hosting and infrastructure services including, but not limited to: VPS, dedicated servers, shared web hosting, colocation, VPN, DNS hosting, and network services. We reserve the right to modify or discontinue any service without prior notice.
3. Ordering and Agreement
An agreement is entered into when the customer completes an order through our order portal and payment is confirmed. By using our services, the customer agrees to these terms.
4. Account Registration and Security
- The customer must provide accurate and complete information during registration
- The customer is responsible for keeping login credentials secure
- The customer is liable for all activity occurring under their account
5. Payment Terms
- All services are invoiced in advance
- Payment is due within 14 days from the invoice date
- Failure to pay may result in service suspension after a reminder has been issued
- We accept credit/debit card (Visa, Mastercard), invoice, Monero (XMR), and Bitcoin (BTC)
- All prices are listed excluding VAT
- Price adjustments may occur, and customers will be informed in advance
- Payments are non-refundable unless stated otherwise
6. Acceptable Use
The Customer agrees not to use our services for:
- Illegal activities under Swedish law
- Distribution of malware or phishing content
- Sending spam or unsolicited bulk email
- Unauthorized access to other computer systems
- Activities that disrupt other customers’ services or place disproportionate load on the infrastructure
- Running heavily loaded VPN nodes is not allowed on our VM infrastructure
In the event of a violation of these terms, we reserve the right to immediately suspend the service. We will inform the customer if their usage causes problems.
7. Uptime and SLA
No uptime guarantee (SLA) is included in standard services. SLA agreements with defined uptime levels and compensation terms may be purchased separately per service. Contact us for more information.
8. Data and Backups
Cloud services (VPS, shared hosting) include automatic backups unless otherwise stated. The customer is always responsible for maintaining their own backups of important data. Colocation and dedicated servers do not include backups by default but may be purchased separately. We are not responsible for any data loss.
9. Limitation of Liability
The Provider’s liability is limited to direct damages and shall never exceed the amount the Customer has paid for the relevant service during the preceding 12 months. We are not liable for:
- Indirect or consequential damages
- Lost data (the Customer is responsible for their own backups in addition to those we provide)
- Damage caused by force majeure
- Interruptions caused by the Customer’s own equipment or software
10. Customer Responsibilities
The Customer is responsible for:
- All content stored on or distributed through our services
- Keeping login credentials secure
- Maintaining their own backups of important data
- Complying with applicable laws and regulations
11. Termination
- The Customer may cancel a service at any time through the customer portal
- The already paid period is honored until its end
- We reserve the right to suspend or terminate services without prior notice in the event of a breach of these terms — no refund will be issued in such cases
- Upon termination, customer data is deleted after 30 days
12. Amendments
We may update these terms. Material changes will be communicated via email at least 30 days in advance. Continued use of the service after changes constitutes acceptance of the new terms.
13. Applicable Law and Disputes
Swedish law applies. Any disputes that cannot be resolved through negotiation shall be settled by a Swedish general court.
